1. Acceptance of Terms

These Terms of Service (Terms) govern your access to and use of ColorVol, including the website, dashboard, options analytics tools, AI chat, billing features, saved strategy tools, shared strategy links, and related services, which we call the Service. By accessing or using the Service, creating an account, or purchasing a plan, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and Accounts

You must have legal capacity to enter into these Terms and use the Service in compliance with applicable law. You are responsible for your Google account, devices, access credentials, account activity, and the accuracy of information you provide. You must promptly notify us at [email protected] if you believe your account or access to the Service has been compromised.

3. Service Description

ColorVol provides options analytics, volatility surfaces, gamma exposure visualizations, probability tools, saved strategies, strategy sharing, AI-assisted explanations, and related market-analysis features. The Service may include free and paid features, token-metered AI usage, third-party market data, and third-party AI model access. We may update, change, limit, or discontinue features from time to time, subject to any mandatory rights you have under applicable law.

4. Not Financial Advice

The Service is provided for informational, educational, and analytical purposes only. ColorVol does not provide investment advice, financial advice, trading advice, tax advice, legal advice, portfolio management, broker-dealer services, investment advisory services, or order execution. Nothing in the Service is an offer, recommendation, solicitation, or instruction to buy, sell, hold, or trade any security, option, derivative, or financial instrument.

Options trading is risky and can result in substantial losses, including losses greater than your initial investment for some strategies. You are solely responsible for your decisions, risk management, legal compliance, and use of any information generated by the Service. Consult qualified, regulated professionals before making financial decisions.

5. Market Data, Analytics, and AI Outputs

Market data, calculations, charts, Greeks, volatility metrics, gamma exposure estimates, probability outputs, and AI responses may be delayed, incomplete, inaccurate, unavailable, or based on assumptions that do not match live market conditions. Third-party data sources and AI providers may change, fail, restrict access, or return erroneous information. AI outputs can be wrong or misleading and must be independently verified. You must not rely on the Service as the sole basis for trading, investment, or financial decisions.

6. Subscriptions, Tokens, and Billing

Paid plans, prices, included features, token allowances, renewal periods, and billing terms are shown in the Service or checkout flow. Payments are processed by Stripe, and Stripe may apply its own terms and privacy practices. Unless stated otherwise at checkout, paid subscriptions renew automatically until canceled. You can manage or cancel your subscription through the billing portal where available. Cancellation generally takes effect at the end of the current billing period unless applicable law, Stripe, or the plan terms require a different result.

Tokens are Service credits used to meter access to AI and other token-gated features. Tokens have no cash value, are not legal tender, are not transferable, and cannot be redeemed for money. We may correct token balances affected by error, abuse, refund, chargeback, fraud, or technical failure. Refunds are provided only where stated by the plan terms or required by applicable law. Taxes, currency conversion, bank fees, and payment-provider fees may apply.

7. EU and Consumer Rights

Nothing in these Terms limits rights that cannot be waived under applicable consumer protection, digital services, data protection, or other mandatory law. If you are a consumer in the European Union, European Economic Area, United Kingdom, or another jurisdiction with mandatory consumer rights, those rights remain unaffected. Limitations, disclaimers, cancellation rules, refund restrictions, governing-law terms, and liability caps apply only to the maximum extent permitted by law.

8. Acceptable Use

You agree not to misuse the Service or help others misuse it. Prohibited conduct includes violating law; infringing intellectual property or privacy rights; submitting unlawful, harmful, or sensitive personal information; attempting unauthorized access; bypassing security or rate limits; introducing malware; scraping, crawling, or automating access in a way that burdens the Service; reverse engineering except where allowed by law; reselling, sublicensing, or redistributing the Service or Service data without written permission; using the Service to provide regulated financial advice as if endorsed by ColorVol; or using the Service in a way that could damage, disable, overburden, or impair our systems or providers.

9. User Content and Shared Strategies

You remain responsible for prompts, messages, saved trades, strategy inputs, names, shared strategy links, and other content you submit or create through the Service, which we call User Content. You grant ColorVol a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, reproduce, and use User Content as needed to provide, secure, support, and improve the Service and to display shared strategy links to anyone who has access to those links. You represent that you have the rights needed to submit User Content and that it does not violate law or third-party rights.

10. Intellectual Property

The Service, including software, design, branding, charts, interfaces, text, graphics, workflows, and other materials, is owned by ColorVol or its licensors and is protected by intellectual property and other laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your own lawful internal, personal, or business analysis. No rights are granted except as expressly stated in these Terms.

11. Third-Party Services

The Service may depend on third-party services, data, software, and infrastructure, including Google, Stripe, OpenRouter, AI model providers, market data providers, hosting providers, and database providers. We are not responsible for third-party services to the extent permitted by law. Your use of third-party services may be subject to their own terms, policies, availability limits, and fees.

12. Suspension and Termination

We may suspend or terminate access to the Service, remove content, limit features, or refuse transactions if we reasonably believe you breached these Terms, created risk for ColorVol or others, failed to pay amounts due, violated law, abused tokens or refunds, compromised security, or used the Service in a way that harms our systems, providers, or users. Where reasonable and legally required, we will provide notice or an opportunity to resolve the issue. You may stop using the Service at any time and may cancel paid plans through available billing tools.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided AS IS and AS AVAILABLE without warranties of any kind, whether express, implied, statutory, or otherwise. We do not warrant that the Service will be uninterrupted, secure, accurate, complete, current, profitable, error-free, or suitable for your intended use. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade, except where such disclaimers are not allowed by law.

14. Limitation of Liability

To the maximum extent permitted by law, ColorVol and its operators, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; trading losses; investment losses; lost profits; lost revenue; lost data; business interruption; loss of goodwill; or damages caused by market data, analytics, AI outputs, third-party services, or your financial decisions. To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid to ColorVol for the Service in the 12 months before the claim or 100 EUR.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, intentional misconduct, death or personal injury caused by negligence, gross negligence where it cannot be limited, or any other liability that cannot be excluded or limited by applicable law.

15. Indemnity

If you use the Service on behalf of a business, organization, or other legal entity, or otherwise use the Service for business purposes, you agree to defend, indemnify, and hold harmless ColorVol and its operators, affiliates, licensors, and service providers from claims, damages, liabilities, costs, and expenses arising from your use of the Service, User Content, breach of these Terms, violation of law, or infringement of third-party rights. This section applies to consumers only to the extent permitted by applicable law.

16. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new date at the top of the page. If changes materially affect paid features or your rights, we will provide additional notice where required by law. Continued use of the Service after updated Terms take effect means you accept the updated Terms. If you do not agree, you must stop using the Service and cancel any paid plan.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except that mandatory consumer protection laws of your country of residence continue to apply where required. To the extent legally permitted, disputes will be resolved in the state or federal courts located in Delaware. If you are a consumer with mandatory rights to bring claims in your local courts or under your local law, those rights are not limited by these Terms.
